Terms of Use and Terms of Sale

Part 1 — Terms of Use

1. Purpose

These Terms of Use govern access to and use of the UEFNSTORE platform (hereinafter "the Platform"), published by EI GAY Simon. The Platform is a marketplace allowing sellers to offer digital products (assets, maps, plugins, etc.) intended for Unreal Editor for Fortnite (UEFN), and buyers to purchase them.

2. Acceptance

Registration and use of the Platform imply full and unconditional acceptance of these Terms of Use. If you do not accept these terms, you must not use the Platform.

3. Registration

  • Registration is restricted to individuals aged 16 years or older.
  • Registration is performed via a Discord account (OAuth).
  • Each user may only have one account.
  • The user is responsible for maintaining the confidentiality of their credentials.

4. Seller Accounts

To sell on the Platform, the user must complete the seller registration process, including identity verification and connecting a Stripe Connect account. Sellers agree to:

  • Only offer products for which they hold the intellectual property rights.
  • Provide accurate and non-misleading descriptions.
  • Comply with third-party rights and Epic Games / UEFN terms of use.
  • Not offer any illegal, malicious, or morally objectionable content.

5. Prohibited Content

The following are strictly prohibited on the Platform:

  • Any content infringing on third-party intellectual property rights, including the upload of stolen, copied, or redistributed assets without authorization.
  • Any illegal, defamatory, discriminatory, or hate-inciting content.
  • Any malware, viruses, cheats, or exploits.
  • Any pornographic or violent content.
  • Any attempt at fraud, review manipulation, or circumvention of the Platform's systems.
  • Any creation of multiple accounts for the purpose of circumventing a sanction.

6. Intellectual Property and Claims (DMCA / Rights Holders)

UEFNSTORE respects intellectual property rights. If a rights holder believes that a product published on the Platform infringes their rights, they may submit a claim to contact@playandchill.bet including:

  • Identification of the disputed content (link to the product).
  • Proof of ownership of the rights (link to the original work, certificate, etc.).
  • Contact details of the claimant.

Upon receipt of a valid claim, the product in question will be immediately removed without prior notice. The seller will be notified and may contest the claim. In case of repeated infringement, the seller account will be permanently suspended.

7. Moderation and Content Removal

Each product and each version is subject to review by the moderation team before publication. UEFNSTORE reserves the right, at its sole discretion, to:

  • Refuse the publication of a product, without having to justify its decision.
  • Remove any product or version at any time, without prior notice or compensation, for any reason whatsoever, including but not limited to: violation of the Terms, rights holder complaint, content deemed inappropriate, or editorial decision.
  • Edit or remove reviews or discussions that violate the Platform's rules.

Sellers acknowledge and accept that publication on UEFNSTORE does not constitute an acquired right and may be revoked at any time.

8. Liability

UEFNSTORE acts as a technical intermediary. The Platform shall not be held liable for the content of products published by sellers, nor for their conformity to buyers' expectations. Transactions are carried out directly between sellers and buyers.

Sellers are solely responsible for the legality, originality, and quality of the products they publish. In the event of a third-party claim, the seller agrees to indemnify UEFNSTORE against any legal action.

9. Sanctions, Suspension, and Banning

In the event of a violation of these Terms, UEFNSTORE may apply the following sanctions, without prior notice or formal demand:

  • Warning: notification of the violation to the account concerned.
  • Temporary suspension: restricted access to the account for a determined period.
  • Content removal: immediate removal of the infringing product(s).
  • Permanent ban: permanent deletion of the account and prohibition from re-registering.

Funds in the process of being transferred may be withheld in cases of proven fraud or ongoing disputes. Sanctions do not entitle the user to any compensation.

The user may delete their account at any time by contacting contact@playandchill.bet.

Part 2 — Terms of Sale

10. Products

Products sold on UEFNSTORE are digital goods (downloadable files). They may be offered for free or for a fee. Prices are displayed in United States dollars (USD), inclusive of all applicable taxes.

11. Pricing and Commission

  • Free products incur no charges.
  • Paid products have a minimum price of $5.00 USD.
  • A commission of 15% is charged by the Platform on each sale. The seller receives 85% of the sale price. Stripe fees (2.9% + $0.30 USD) are deducted from the Platform's commission.
  • Payments are processed by Stripe. Payouts to sellers are automatic.

12. Purchase Process

  1. The buyer selects a product and proceeds to payment via Stripe Checkout.
  2. For free products, the buyer adds them directly to their library.
  3. After payment validation, the product is immediately available for download.

13. Right of Withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a tangible medium, the performance of which has begun with the consumer's consent. By proceeding with the purchase and download, the buyer expressly waives their right of withdrawal.

14. Refunds

Refunds may be granted on a case-by-case basis in the following situations:

  • The product is significantly different from its description.
  • The file is corrupted or unusable and the seller does not provide a fix.
  • A technical error preventing the download.

Refund requests must be sent to contact@playandchill.bet within 14 days of the purchase.

15. License of Use

The purchase of a product grants the buyer a personal, non-exclusive license of use. Unless otherwise stated by the seller, the buyer is not authorized to resell, redistribute, or sublicense the product.

16. Warranties

Digital products are provided "as is". UEFNSTORE does not guarantee the compatibility of products with all versions of UEFN nor their suitability for a particular purpose.

Part 3 — Common Provisions

17. Modification of Terms

UEFNSTORE reserves the right to modify these terms at any time. Users will be informed of any substantial changes. Continued use of the Platform after modification constitutes acceptance of the new terms.

18. Applicable Law and Disputes

These terms are governed by French law. In the event of a dispute, the parties agree to seek an amicable resolution. Failing that, French courts shall have exclusive jurisdiction.

In accordance with Article L.612-1 of the French Consumer Code, the consumer may use a consumer mediator free of charge for the amicable resolution of a dispute.
